Remember Commissioner Eva Henry & Commissioner Chaz Tedesco voted for this fee! They are coming up for re-election in 2016.

Judge Warner States:

  • "In fact, a fee may be charged to persons who do not use the services whatsoever."
  • "The utility is a government-owned business"
  • "therefore an “enterprise” that is exempted from TABOR."

" No Taxation Without Representation "

      My name is Ted Stallone. I have been a part of the lawsuit against the County Stormwater TAX initiative, that was imposed on the people of Adam's Co., without their voted approval. An Adam's Co. Judge (Judge Warner), ruled against the people.

    When does it stop when a government entity can impose a financial burden (at ANY government level and ANY dollar amount) without the concent of the people? It is on these principle grounds that I got involved in this battle.

Is it not everyone's responsibility to carry on the non-ending fight to protect this great country from totalitarian governments? When I hear that those that originally approved this TAX measure (Civil servants that work for you) laughed and cheered at our loss, I want to continue to do more.

If there is a legal precedent that would allow this to be appealed to the U.S. Supreme Court, I would do it.

   But financial support is paramount to continue this fight. Please spread the word, and donate to the cause. Our Founding Fathers would be proud of your support!

Adams County stormwater fee program under question again!

"Adams County's treasurer and one of its commissioners are asking for an investigation into the county's stormwater program, which started last year, after finding that it again may be riddled with errors.

Commissioner Erik Hansen said he was made aware Tuesday that the county sent delinquency notices to more than 12,000 Adams County home and business owners who haven't paid stormwater fees, but that some may have incorrect account numbers and information on them."   Read More

The Idaho Supreme court ruled the stormwater fee was instead a tax. As such, the city did not have the legal authority to levy the tax. Only the state legislature could do that.

BOCC Meeting

 Our organization, representing all unincorporated Adams County citizens and business owners, has engaged an experienced law firm to protect our rights and we need your help!

Sean Gallagher, from Polsinelli and Shughart (www.polsinelli.com) represented us at the Board of County Commissioners Meeting on April 29th.
It was a great success. Hundreds of concerned citizens showed up to voice their opposition to the illegal tax.

The Adams County Colorado Board of Commissioners recently approved the formation of a Stormwater Utility for unincorporated Adams County.

This means that you will be charged a "fee" for the amount of rain or snow that falls on your roof and driveway. This fee will show on your property tax bill. (They are calling it a fee, we think it is really a tax being imposed without voter approval).

If you live in unincorporated Adams County, you WILL be affected by this tax and should get involved in our efforts to defeat and eliminate it.

Adams County commissioners cap stormwater fees temporarily

Adams County has temporarily converted its controversial new stormwater fee to a flat rate and will convene a citizens advisory panel in response to a rush of opposition and threats of litigation.

SSUA feels this resolution is drafted as a "temporary" appeasement to quiet the crowd.  Once citizens are no longer engaged in the process, the commissioners will have "free reign" to elevate the fee structure back to pre-determined levels or higher.
